Terms of Service

Overview

These terms establish the agreement between users and ModernTyrTech regarding access to www.moderntyr.tech. Users must be at least 18 years old. ModernTyrTech reserves the right to modify the platform and terms at any time, with changes effective immediately upon posting. Continued use indicates acceptance of updates.

Services

ModernTyrTech provides custom web development services including backend integrations, custom dashboards, admin interfaces, API development, and full-stack web applications through the platform. The company reserves rights to implement new elements and modify existing functionality. Users understand that service purchases aren't contingent on future feature releases or third-party services continuing indefinitely.

Intellectual Property

All platform content — including text, graphics, videos, logos, and databases — belongs to ModernTyrTech or its licensors. The ModernTyrTech name and related logos are trademarks and service marks that require written permission for use. Third-party trademark usage doesn't imply ModernTyrTech endorsement.

Limited License and Prohibited Uses

Users receive a personal, non-exclusive, revocable license to access platform content. Prohibited activities include:

• Violating applicable laws
• Exploiting or harming individuals
• Sending spam or unlawful promotional material
• Impersonating ModernTyrTech employees or other users
• Using automated devices to access the platform
• Introducing malicious code
• Attempting unauthorized access or denial-of-service attacks

Customer/End User Conduct

Users remain responsible for employee and client actions. They must maintain necessary licenses and permissions, provide accurate data, and ensure compliance with all applicable laws when using deliverables provided by ModernTyrTech.

Payment

Project fees are outlined in individual project agreements or statements of work. Users must provide accurate billing information. All fees are nonrefundable. Users bear responsibility for applicable taxes and surcharges.

Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of any project agreement. Excessive data use may slow service performance. ModernTyrTech may suspend accounts or reduce data usage limits if use becomes excessive or abusive.

Data Storage

ModernTyrTech assumes no responsibility for deleted or unstored content. The company may remove accounts that haven't paid subscription fees, maintain negative balances, or violate terms.

Representations and Warranties

Users must provide complete, current, and accurate registration information. Users maintain responsibility for login credential confidentiality. They must notify ModernTyrTech of unauthorized account access immediately. ModernTyrTech may disable credentials at its discretion.

Feedback and User Contributions

Users retain ownership of their data while granting ModernTyrTech rights to use it for service provision and business improvement. For submitted ideas, ModernTyrTech may already be working on the same or a similar idea, or it may have received a similar or identical idea from other sources.

Copyright

Copyright infringement claims should be emailed to legal@moderntyr.tech with specific details. Counter-notices are accepted with identifying information and good-faith statements. Removed content may be reposted after 10-14 business days unless legal action is filed.

Third Party Content

The platform may include third-party materials. ModernTyrTech is not responsible for third-party content accuracy and does not represent their opinions.

Linking to Platform

External links are provided for convenience without implying endorsement. ModernTyrTech doesn't control external sites or guarantee their content.

Disclaimer

THE PLATFORM AND THE SERVICES OFFERED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. MODERNTYRTECH MAKES NO GUARANTEES REGARDING PLATFORM FUNCTIONALITY, CONTENT ACCURACY, OR SERVICE RELIABILITY. USERS ACKNOWLEDGE INTERNET NETWORKS ARE INHERENTLY INSECURE.

Limitation of Liability

Liability caps at amounts paid during the preceding three months. ModernTyrTech is not liable for special, punitive, indirect, or consequential damages.

Indemnification

Users agree to defend ModernTyrTech against claims arising from their platform use, including regulatory violations, breaches, misrepresentations, and tax disputes.

Waiver and Severability

Legal action must commence within three months of the triggering event. Failure to enforce terms doesn't constitute waiver. Invalid provisions are eliminated while others remain enforceable.

Assignment

Terms remain binding during and after platform use. Relevant sections survive account termination.

Entire Agreement

These terms constitute the complete agreement and supersede prior understandings. Separate written agreements with ModernTyrTech take precedence in case of conflicts.

Force Majeure

ModernTyrTech is excused from delivery delays caused by unforeseeable events beyond reasonable control.

Applicable Law

Texas law governs these terms. Disputes are exclusively settled through binding arbitration administered by the American Arbitration Association in Dallas, Texas.

Arbitration and Waiver of Class Action

All disputes must be arbitrated individually rather than on a class basis. Multiple customers' claims cannot be consolidated.

Miscellaneous

ModernTyrTech prohibits third-party network access, penetration testing, or security assessments without authorization. Users providing client access to deliverables must implement equivalent privacy protections and obtain consent.

Communications and Contact

ModernTyrTech may contact users via email or other provided information. Users can unsubscribe from communications. The company never requests confidential information via email.
